These Terms and Conditions ("Terms") govern your access to and use of www.boostingalpha.com (the "Site") and any products, services, software, reports, analytics, alerts, research tools, AI-generated insights, dashboards, applications, content, or subscriptions provided by Boosting Alpha B.V. ("Boosting Alpha", "we", "our", or "us"). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree to these Terms, you should not access or use the Site.

1. Eligibility

The Site and Services are intended only for individuals who are at least eighteen (18) years of age and legally capable of entering into binding agreements. By using the Site, you represent and warrant that you satisfy these requirements.

2. Services

Boosting Alpha provides market intelligence, stock screening, earnings analysis, anomaly detection, AI-enhanced research, watchlists, alerts, analytics, reports, dashboards, and related informational services. The Services are designed to assist users in conducting their own research and are provided solely for informational and educational purposes.

3. No Investment Advice

Boosting Alpha is not a registered investment adviser, broker-dealer, portfolio manager, financial planner, or fiduciary. Nothing available through the Site or Services constitutes investment advice, financial advice, tax advice, legal advice, portfolio management services, brokerage services, a solicitation, or a recommendation to buy, sell, or hold any security, financial instrument, or investment product. All information made available through the Services is general in nature, is not tailored to any user's personal circumstances, financial objectives, or risk profile, and should not be relied upon as a substitute for professional advice. Users remain solely responsible for evaluating information and making their own investment decisions.

4. AI-Generated Content Disclaimer

Users may not share accounts, transfer accounts to third parties, or permit unauthorized access to the Services. Boosting Alpha reserves the right to suspend or terminate accounts that violate these Terms or present security risks.

8. Acceptable Use

Users may not scrape, copy, harvest, reverse engineer, redistribute, republish, resell, reproduce, modify, or otherwise exploit any part of the Site, Services, reports, analytics, alerts, software, databases, or AI-generated outputs without the prior written consent of Boosting Alpha. Users may not use automated tools, bots, scripts, or similar technologies to access or extract information from the Services except where expressly authorized. Users further agree not to interfere with the operation, security, or integrity of the Site or to use the Services in violation of any applicable law or regulation.

9. Intellectual Property

All content available through the Site and Services, including software, reports, analytics, alerts, rankings, AI-generated outputs, trademarks, logos, graphics, databases, text, and other materials, is owned by or licensed to Boosting Alpha and is protected by applicable intellectual property laws. Except as expressly permitted under these Terms, no rights are granted to users in relation to the Site or Services. Boosting Alpha reserves all rights not expressly granted herein.

10. Subscription Services, Billing and Free Trials

Certain Services are available only through a paid subscription. By purchasing a subscription, you authorize Boosting Alpha to charge the applicable subscription fees, taxes, and any other disclosed charges to your selected payment method.

Subscription fees are billed in advance on a recurring basis, either monthly or annually, depending on the subscription plan selected at the time of purchase. Access to paid Services will continue until the subscription is cancelled or terminated in accordance with these Terms.

Boosting Alpha may offer free trials, promotional access, discounted introductory periods, or other special offers from time to time. Unless otherwise stated at the time of registration, a free trial will automatically convert into a paid subscription at the end of the trial period. To avoid being charged, users must cancel their subscription before the free trial expires. If a user does not cancel before the end of the trial period, the applicable subscription fee will be charged automatically using the payment method on file.

Users may upgrade or downgrade their subscription plans at any time. If a user upgrades to a higher-tier plan during an active billing cycle, the user will be charged a prorated amount reflecting the difference between the current plan and the upgraded plan for the remainder of the billing period. The upgraded features will become available immediately upon successful payment.

If a user downgrades to a lower-tier plan, the downgrade will take effect at the beginning of the next billing cycle unless otherwise specified. No refunds or credits will be issued for unused portions of the current subscription period.

Users may cancel their subscription at any time through their account settings or by contacting customer support. Cancellation will take effect at the end of the current paid billing period, and access to paid features will continue until that period expires. Subscription fees already paid are non-refundable except where required by applicable law.

Boosting Alpha reserves the right to modify subscription pricing, features, or service offerings at any time. Existing subscribers will receive reasonable notice of any material pricing changes before such changes become effective. Continued use of the Services after the effective date of a pricing change constitutes acceptance of the revised pricing.

If any payment cannot be successfully processed, Boosting Alpha may suspend or terminate access to paid Services until payment is received. Boosting Alpha reserves the right to use third-party payment processors and billing providers to facilitate subscription payments.

No refunds will be granted based on investment performance, trading outcomes, dissatisfaction with market conditions, or disagreement with AI-generated analyses, rankings, alerts, forecasts, or insights.

11. Automatic Renewal and Cancellation

Unless otherwise specified, subscriptions automatically renew at the end of each billing period using the payment method on file. Users may cancel their subscription at any time through their account settings or by contacting customer support. Cancellation will take effect at the end of the current paid subscription period, and users will continue to have access to the subscribed Services until that date. No partial refunds will be provided unless required by applicable law.

12. Refund Policy

Except where required by applicable law, subscription fees are non-refundable. Boosting Alpha does not provide refunds or credits for partially used subscription periods, unused Services, or account inactivity. Any free trial may be cancelled before conversion to a paid subscription without charge.

13. Service Availability

Boosting Alpha strives to maintain reliable access to the Services but does not guarantee uninterrupted availability. The Site and Services may be temporarily unavailable due to maintenance, technical issues, system failures, third-party service interruptions, cybersecurity incidents, or events beyond our reasonable control. Alerts, reports, notifications, analytics, and data feeds may occasionally be delayed or unavailable.

14. Disclaimer of Warranties

The Site and Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Boosting Alpha disclaims all warranties, whether express, implied, statutory, or otherwise, including any warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, completeness, availability, or uninterrupted operation. Your use of the Site and Services is entirely at your own risk.

15. Limitation of Liability

Boosting Alpha provides market intelligence, analytics, research tools, AI-generated insights, and informational content only. Boosting Alpha does not execute trades, manage assets, provide discretionary investment management, operate trading accounts, or make investment decisions on behalf of users.

To the fullest extent permitted by applicable law, Boosting Alpha, its affiliates, directors, officers, employees, contractors, licensors, suppliers, and service providers shall not be liable for any trading losses, investment losses, loss of profits, loss of revenue, loss of business opportunities, loss of portfolio value, loss of goodwill, loss of data, business interruption, or any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the use of, inability to use, or reliance upon the Site, Services, reports, alerts, analytics, rankings, forecasts, watchlists, scores, AI-generated outputs, or other content made available through the platform.

Users acknowledge that all investment and trading decisions are made at their own risk and that financial markets involve substantial uncertainty. In no event shall Boosting Alpha's total aggregate liability arising from or relating to the Site or Services exceed the total amount paid by the user to Boosting Alpha during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms shall exclude or limit liability to the extent such exclusion or limitation is prohibited by applicable law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Boosting Alpha, its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against any claims, losses, damages, liabilities, costs, expenses, or legal fees arising out of or relating to your use of the Site or Services, your violation of these Terms, your violation of applicable laws, or your infringement of any third-party rights.

17. Suspension and Termination

Boosting Alpha may suspend, restrict, or terminate access to the Site or Services at any time if it reasonably believes that a user has violated these Terms, engaged in fraudulent or unlawful conduct, compromised platform security, or otherwise created risks for Boosting Alpha, its users, or third parties. Termination shall not affect any rights or obligations that accrued prior to termination.

18. Privacy

Your use of the Site and Services is also governed by the Boosting Alpha Privacy Policy, which forms part of these Terms. By using the Site, you acknowledge that your personal information may be collected, processed, and stored in accordance with the Privacy Policy.

19. Changes to These Terms

Boosting Alpha reserves the right to modify these Terms at any time. Updated Terms will become effective upon publication on the Site unless otherwise stated. Your continued use of the Site or Services following the publication of revised Terms constitutes acceptance of the updated Terms.

20. Governing Law

These Terms and any dispute arising out of or relating to the Site, Services, or these Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to conflict of law principles.

21. Jurisdiction

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services shall be subject to the exclusive jurisdiction of the competent courts of the Netherlands.
